The terms, in plain words first.
IHearYou is a friend you can talk to, built on AI. It listens and keeps you company. It is not a person, not a professional, and not for emergencies. You use it at your own choice and your own risk. The full terms are below.

1. Agreeing to these terms
By opening an account or using IHearYou, the app, the website or anything on them (together, "IHearYou"), you agree to these terms and to the privacy page. If you do not agree, do not use IHearYou. "We" and "us" mean the people who make and run IHearYou.
2. What IHearYou is, and what it is not
IHearYou is an AI. The friend you talk to is software, not a person. It is not a doctor, nurse, therapist, counselor, social worker, case worker, lawyer or financial adviser, and nothing it says is medical, mental health, legal, financial or any other professional advice. Using IHearYou does not create a professional, clinical or care relationship of any kind between you and us.
IHearYou is not for emergencies and is not a crisis service. It does not call anyone for you and may not understand that you are in danger. If you are in danger or thinking about hurting yourself or someone else, call 911. In the US you can call or text 988 at any time and reach a person.
3. Who can use it
You must be 18 or older. By using IHearYou you confirm that you are.
4. AI makes mistakes
What the friend says is written by AI. It can be wrong, incomplete, out of date or unsuitable for you, and it can misremember or mishear. Do not rely on it for any decision about your health, safety, money, housing, legal matters or anything else that matters. Check anything important with a qualified person. What you decide and do after using IHearYou is your choice and your responsibility.
5. Programs and caregivers
If you use IHearYou through a program, the program may see short summaries of your conversations, as the privacy page explains. The program, its staff and its caregivers are independent of us. They are responsible for their own decisions, care and conduct, and we are not responsible for what they do or do not do.
IHearYou may tell a caregiver when something you say sounds like danger. This is a best effort, not a monitoring or alert service: it may miss things, flag things wrongly, or arrive late, and nobody may be watching. Never count on IHearYou to get you help.
6. What you share
You keep whatever you say. You give us permission to store, process and use it to run IHearYou for you, to keep it safe, and to make it better, as described on the privacy page. We never sell what you share and never use your name or your words in public.
IHearYou is run with the help of service providers, such as companies that provide AI models, speech recognition, voices, hosting and storage. What you say passes through them so the friend can hear, think and answer.
7. Using it fairly
Do not use IHearYou to break the law, to harm, threaten or harass anyone, to pretend to be someone else, or to try to break, overload, copy or get around how it works. Keep your PIN to yourself; you are responsible for what happens under your account. We may limit, suspend or close an account that breaks these terms or puts anyone at risk.
8. It may change or stop
IHearYou is free to try. We may change it, pause it or stop it, in whole or in part, at any time and without notice. We do not promise it will always be available, work without errors, or keep any particular feature.
9. No warranties
IHearYou is provided "as is" and "as available". To the fullest extent the law allows, we make no promises or warranties of any kind, express or implied, including that it is accurate, reliable, safe, suitable for any purpose, uninterrupted or free of errors, and we disclaim all implied warranties of merchantability, fitness for a particular purpose and non-infringement.
10. Limits on our responsibility
To the fullest extent the law allows, we, and the people who make, run, fund or support IHearYou, are not responsible or liable for any harm, loss or damage that comes from using or not being able to use IHearYou, from anything the friend says or does not say, from anything you or anyone else does after using it, from any program or caregiver, or from any service provider. This includes indirect, incidental, special, consequential, exemplary and punitive damages, and loss of data, health, income or opportunity, even if we were told they could happen.
If, despite this, we are found responsible for anything, our total responsibility to you for all claims together is limited to the greater of what you paid us for IHearYou in the twelve months before the claim, or fifty US dollars.
Some places do not allow some of these limits. Where that is so, they apply as far as the law there allows.
11. If someone makes a claim because of how you used it
You agree to defend and hold harmless us and the people who make, run, fund or support IHearYou against any claim, loss or cost, including reasonable legal fees, that comes from your use of IHearYou in breach of these terms or of the law, or from what you share.
12. The legal part
These terms are governed by the laws of the State of Nevada, United States, without regard to conflict of law rules. Any dispute about IHearYou or these terms will be decided only by the state or federal courts in Clark County, Nevada, and you and we agree to their jurisdiction.
We may update these terms. When we do, the date at the top changes; using IHearYou after that means you accept the new terms. If any part of these terms cannot be enforced, the rest still applies. If we do not enforce a term, we have not given it up. These terms and the privacy page are the whole agreement between you and us about IHearYou.
